STANDARD 38: HOT TUBS (EXTERIOR)<\/p>\n

1.0<\/p>\n
DEFINITIONS<\/p>\n
1.1<\/p>\n
For the purpose of this Standard, a Hot Tub shall be defined as a large tub that<\/p>\n
can accommodate two or more persons, and is filled with hot aerated water and<\/p>\n
used for recreation and\/or physical therapy.<\/p>\n
2.0<\/p>\n
OBLIGATIONS<\/p>\n
21<\/p>\n
The member is hereby noticed that the Mutual may need to perform repairs and<\/p>\n
maintenance to the manor and patio walls, and any damage that could result to<\/p>\n
the hot tub, during any such repairs or maintenance, absent negligence or willful<\/p>\n
misconduct by United Mutual or VMS, would be the responsibility of the Member<\/p>\n
and not United Mutual.<\/p>\n
2.2<\/p>\n
Further, the member is responsible to move and\/or remove the hot tub as<\/p>\n
necessary to facilitate the performance of any needed maintenance and repairs<\/p>\n
to Mutual property.<\/p>\n
2.3 The member is required to provide proof of personal liability insurance with limits<\/p>\n
of at least $200,000 per occurrence with an insurer with an AM Best rating or A-<\/p>\n
VIII or higher and to name United Laguna Woods Mutual and VMS, Inc. as an<\/p>\n
additional insure with written proof to be forwarded to the Village Management<\/p>\n
Services Risk Management Division annually. Limits may be a combination of<\/p>\n
homeowners and\/or umbrella or excess liability insurance.<\/p>\n

Installation must be performed by a California licensed contractor of the<\/p>\n
appropriate trade.<\/p>\n
3.0<\/p>\n
APPLICATIONS<\/p>\n
3.41<\/p>\n
A hot tub may only be installed on top of a concrete patio slab surrounded by<\/p>\n
patio walls at least five foot in height, and at ground level with no adjacent<\/p>\n
common walls. A hot tub must be portable and may not be permanently installed<\/p>\n
in any fashion.<\/p>\n
3.2<\/p>\n
Hot tubs on balconies, atriums with adjacent common walls, or raised platforms<\/p>\n
are prohibited.
\n3.3<\/p>\n
A Mutual Consent for Manor Alterations is required for the hot tub and, if<\/p>\n
required, the member must obtain a City of Laguna Woods building permit for<\/p>\n
electrical or plumbing modifications made to accommodate the hot tub.<\/p>\n
3.4<\/p>\n
A hot tub may only drain into the sanitary sewer system, and not into the street,<\/p>\n
the storm drains, or adjacent landscaped areas.<\/p>\n
3.5<\/p>\n
A hot tub must be covered and should be locked when not in use, subject to the<\/p>\n
California Building Code.<\/p>\n
3.6<\/p>\n
Hot tubs and the use of hot tubs shall not create a nuisance or otherwise create<\/p>\n
an unreasonable interference with another resident’s use and enjoyment of their<\/p>\n
Manor. The determination of a nuisance or unreasonable interference pursuant<\/p>\n
to this section shall be at the Board’s sole discretion, based on a reasonable<\/p>\n
investigation.
\nResolution 01-17-80<\/p>\n
Hot Tub Standard<\/p>\n
WHEREAS, in United Mutual, no standard exists for exterior hot tub; and<\/p>\n
WHEREAS, the City of Laguna Woods has no standards for the installation and use of<\/p>\n
exterior hot tubs; and<\/p>\n
WHEREAS, it is in the best interests of United Mutual and its members to adopt<\/p>\n
standards regulating the installation and use of exterior hot tubs; and<\/p>\n
WHEREAS, the Board of Directors has consulted with staff, the Governing Document<\/p>\n
Review Committee and legal counsel to develop a standard for the installation and use<\/p>\n
of hot tubs;<\/p>\n
WHEREAS, the standard specifically prohibits hot tubs in atriums with common walls<\/p>\n
and on balconies. Additionally the standard requires that hot tubs be portable, drain only<\/p>\n
in the sanitary sewer, not create a nuisance or otherwise create an unreasonable<\/p>\n
interference with another resident’s use and enjoyment of their Manor, and obtain a<\/p>\n
Mutual Consent for Manor Alterations; and<\/p>\n
WHEREAS, the requesting member is required to provide proof of personal liability<\/p>\n
insurance with limits of at least $200,000 per occurrence with an insurer with an AM<\/p>\n
Best rating or A-VIII or higher and to name United Laguna Woods Mutual and VMS, Inc.<\/p>\n
as additionally named insured; and<\/p>\n
WHEREAS, a hot tub must be covered and may require a lock when not in use, subject<\/p>\n
to the California Building Code; and<\/p>\n
NOW THEREFORE BE IT RESOLVED, that on September 12, 2017, the Board of<\/p>\n
Directors of this Corporation hereby approves a Hot Tub Standard; and<\/p>\n
RESOLVED FURTHER, that the officers and agents of this corporation are hereby<\/p>\n
