All references to \u201cchild\u201d<\/p>\n<p>herein shall be deemed to include the existing resident(s\u2019) or prospective buyer(s\u2019) child or grandchild, if<\/p>\n<p>applicable. Persons who apply for co-occupancy under \u00a751.3 shall submit a disabled child\/grandchild health<\/p>\n<p>certification application, signed by physician for review by the Board of Directors.<\/p>\n<p>Applicants are advised of the following:<\/p>\n<p>* The Board of Directors may deny requests for co-occupancy; therefore, prospective<\/p>\n<p>buyer(s)<\/p>\n<p>are advised to defer opening escrow until a decision is made on the application;<\/p>\n<p>The Board may request additional documentation in considering this application;<\/p>\n<p>The Mutual Member is ultimately responsible for the actions of guests, lessees, and co-occupants;<\/p>\n<p>Occupancy of the manor by more than two persons requires a Third-Party Fee;<\/p>\n<p>Health re-certification shall be required at least annually, unless waived by the Board on a case by<\/p>\n<p>case basis, such as for a chronic and progressive debilitating disease.<\/p>\n<p>By signing the acknowledgement on the reverse side of this form, parents\/grandparents agree to hold<\/p>\n<p>harmless, the Mutual, Golden Rain Foundation and Village Management Services, Inc., Agent, and their<\/p>\n<p>respective directors, officers, agents and employees from any claims arising or based on the presence of or<\/p>\n<p>any alleged property damage or bodily injury or death caused in whole or in part or resulting from actions by<\/p>\n<p>the DISABLED child\/grandchild.<\/p>\n<p>PROCEDURE FOR REQUESTING CO-OCCUPANCY APPROVAL FOR DISABLED<\/p>\n<p>CHILD\/GRANDCHILD<\/p>\n<p>Following are the procedures for obtaining approval by the Board of Directors:<\/p>\n<p>1<\/p>\n<p>Prospective buyer or existing resident submits Disabled Child Health Certification form to the disabled<\/p>\n<p>child\u2019s physician for completion.<\/p>\n<p>2<\/p>\n<p>Physician completes Physician&#8217;s Certification, confirming the child\/grandchild is disabled and explaining:<\/p>\n<p>0<\/p>\n<p>Probable duration of the impairment;<\/p>\n<p>0<\/p>\n<p>Whether there is any probability of behavioral problems resulting or arising from the child\u2019s<\/p>\n<p>impairment which could be harmful to the child or threatening or disturbing to other<\/p>\n<p>residents of<\/p>\n<p>the community, and whether the threat can be ameliorated by means of a reasonable<\/p>\n<p>accommodation.<\/p>\n<p>The specific care that the parents\/grandparents will provide to the disabled child.<\/p>\n<p>Buyer or existing resident completes the acknowledgement of the terms and conditions of approval on the<\/p>\n<p>Certification form, and submits it to the Community Services Department for transmittal to the Board of<\/p>\n<p>Directors for review and approval or disapproval.<\/p>\n<p>Within ten (10) business days from date of receipt of Certification form containing all the required<\/p>\n<p>information, the Board will make its determination. The Community Services Department will transmit the<\/p>\n<p>Board&#8217;s decision to the prospective buyer. If co-<\/p>\n<p>occupant ever shall become the legal or equitable owner of the membership, co-occupant will apply for<\/p>\n<p>membership in the mutual (and will execute an Occupancy Agreement in United Mutual) in the form generally<\/p>\n<p>used by the mutual and will pay all amounts due pursuant to the Occupancy Agreement.<\/p>\n<p>Shareholder and co-occupant shall be equally responsible for payment of any charges incurred by co-occupant in<\/p>\n<p>respect to service provided by the Golden Rain Foundation or the mutual.<\/p>\n<p>Shareholder agrees to pay to the mutual an additional sum each month for each occupant of the unit in excess of<\/p>\n<p>two, at the rate prescribed by the mutual and\/or GRF.<\/p>\n<p>Shareholders shall be responsible for canceling the co-occupancy status and returning co-occupant\u2019s ID card<\/p>\n<p>when co-occupant ceases to reside in the unit.<\/p>\n<p>10<\/p>\n<p>Any party may terminate this agreement at any time upon 30 days written notice to the other parties to this<\/p>\n<p>agreement.<\/p>\n<p>1&#8243;<\/p>\n<p>In order to induce the mutual to execute this agreement, the other parties agree that they have no rights against<\/p>\n<p>the mutual as a direct or indirect result of the execution of this agreement, and in the event that there are any<\/p>\n<p>expenses incurred by the mutual to enforce the terms of this agreement, or to remove or take other action, or to<\/p>\n<p>defend any action relative to shareholder or co-occupant, as a direct or indirect result of this agreement,<\/p>\n<p>shareholder and co-occupant agree to hold the mutual harmless from and to pay all costs or expenses incurred<\/p>\n<p>by the mutual, including, but not limited to, attorney\u2019s fees, court costs or related expenses.<\/p>\n<p>12<\/p>\n<p>Co-occupant(s) affirm that they have not been convicted of a felony within the past 20 years, or a misdemeanor<\/p>\n<p>involving moral turpitude within the past five years.<\/p>\n<p>13<\/p>\n<p>Guests may stay a maximum of 60 days per year, and only while the qualifying senior resident is in<\/p>\n<p>residence.<\/p>\n<p>Notice to shareholders and applicants<\/p>\n<p>Approval of this application by the mutual, in and of itself, does not confer any right on the co-occupant other than the<\/p>\n<p>revocable right to occupy the unit named on the reverse of this form. Each<\/p>\n<p>resident is responsible for his\/her own care and welfare.<\/p>\n<p>HOG insurance coverage is highly recommended in order to cover improvements and alterations<\/p>\n<p>inside and outside the unit, personal property, liability coverage, loss of use, and loss<\/p>\n<p>assessment coverage, that are not covered by United Mutual&#8217;s insurance policy, which would be<\/p>\n<p>the responsibility of the Member.<\/p>\n<p>Appearance of the community is important, and residents are required to keep their balconies,<\/p>\n<p>patios, walkways and carports free from clutter.<\/p>\n<p>When moving into the community, residents are required to break down and stack moving boxes<\/p>\n<p>next to trash dumpsters for routine pickup. Please be advised that there are weight and volume<\/p>\n<p>restrictions. Call CR&#038;R at 949-625-6735 to arrange to have excessive moving material hauled<\/p>\n<p>away as a chargeable service. When moving out of the community, the seller is responsible for<\/p>\n<p>hauling away excessive materials\/furniture.<\/p>\n<p>Members are required to check with the Manor Alterations Department before making any internal<\/p>\n<p>and external alteration, including any landscaping. Contractors\u2019<\/p>\n<p>trash must not be put into community dumpsters.<\/p>\n<p>Relatives and other guests may stay overnight for a total of 60 days in any 12-month period.<\/p>\n<p>Relatives and guests may not stay in a resident&#8217;s home during the absence of the resident.<\/p>\n<p>Board approval is required for all persons wishing to reside in the community. There are additional monthly fees for more than two occupants.<\/p>\n<p>Units may not be sublet for more than 12 months and not less than 30 days.<\/p>\n<p>United is billed directly from the tax assessor and the shareholder\/member reimburses the mutual<\/p>\n<p>through monthly assessments.
