At Laguna Woods Village, you&#8217;ll be amazed at the endless possibilities awaiting you.<\/p>\n<p>COMMUNITY INFORMATION<\/p>\n<p>Laguna Woods Village first opened its gates in an unincorporated area of Orange County on September<\/p>\n<p>10, 1964. Within six months, nearly 900 families had moved into the soon-to-be largest gated,<\/p>\n<p>age-restricted community in the country. Today, more than 18,600 people reside in the Village. The<\/p>\n<p>City of Laguna Woods was incorporated on March 24, 1999, and more than 90% of its population is<\/p>\n<p>made up of Village residents.<\/p>\n<p>Laguna Woods Village is an age-restricted community as defined under California Civil Code \u00a751.3. At<\/p>\n<p>least one occupant must be 55 years of age or older and all other persons who reside in the household<\/p>\n<p>must be at least 45 years of age, unless the other occupant is a spouse or registered domestic partner<\/p>\n<p>or a primary provider of physical health care. Retirement is not a requisite for residency, as many<\/p>\n<p>residents continue to maintain active careers. Any person wishing to reside in the community must<\/p>\n<p>obtain prior approval from the board of directors.<\/p>\n<p>The Village is managed by Village Management Services Inc. (VMS), the management agent<\/p>\n<p>contracted by GRF, Third and United. VMS employs approximately 800 people; more than half of them<\/p>\n<p>are full-time. About 335 are part-time employees, most of whom are community residents. VMS<\/p>\n<p>operates nine departments (and divisions within): CEO\/General Manager&#8217;s office, Department of<\/p>\n<p>Recreation and Special Events, Department of Maintenance and Construction, Department of General<\/p>\n<p>Services, Department of Landscaping Services, Department of Security Services, Department of<\/p>\n<p>Financial Services, Department of Human Resources Services and the Department of Information<\/p>\n<p>Services (which includes Resident Services).<\/p>\n<p>Page 1 of 7<br \/>\nGOVERNANCE<\/p>\n<p>Community governance is organized under California Nonprofit Mutual Benefit Corporation Law. There<\/p>\n<p>are four such corporations, three of which are mutual housing corporations (mutuals). The fourth is the<\/p>\n<p>Golden Rain Foundation (GRF). The mutuals are responsible for services directly related to housing and<\/p>\n<p>common areas, and GRF is responsible for all shared community amenities, including the bus system,<\/p>\n<p>security, clubhouses, swimming pools, golf courses, the equestrian center and other recreational<\/p>\n<p>facilities. Ownership rights include a voting membership to them and a nonvoting membership to GRF.<\/p>\n<p>Each corporation has its own set of governing documents that are provided to each member through<\/p>\n<p>escrow.<\/p>\n<p>Each mutual corporation has a board of directors elected by its members (one vote per dwelling unit).<\/p>\n<p>Board directors are members of the community who serve on a volunteer basis.<\/p>\n<p>GRF has three corporate members\u2014the three mutual corporations. GRF has a board of directors<\/p>\n<p>comprised of members of each of the three housing mutual corporations. The directors of the<\/p>\n<p>corporate members elect GRF board directors. During the annual election process, each corporate<\/p>\n<p>member votes by means of a weighted vote (i.e., the number of dwelling units in the mutual divided by<\/p>\n<p>the number of board members).<\/p>\n<p>Each corporation\u2019s board of directors appoints members to committees for the purpose of reviewing<\/p>\n<p>policies, programs and service levels, and making recommendations to the board of directors. Mutual<\/p>\n<p>committees include, but are not limited to, architectural control, landscaping, finance and<\/p>\n<p>maintenance and construction. GRF committees include landscape, finance, maintenance and<\/p>\n<p>construction, recreation, security, traffic and media and communications. The board of directors<\/p>\n<p>adopts an annual business plan that establishes programs and service levels for each corporation.<\/p>\n<p>MUTUAL CORPORATIONS<\/p>\n<p>The community offers two types of housing: condominiums and stock cooperatives. The definitions of<\/p>\n<p>these two forms of ownership interest are as follows:<\/p>\n<p>Separate Interest &#8211; Condominium: The \u201cseparate interest\u201d is commonly referred to as the air space of<\/p>\n<p>the condominium unit. Each member of a condominium owns an undivided interest in the real<\/p>\n<p>property. Owners of condominiums are issued a grant deed at the close of escrow.<\/p>\n<p>Separate Interest &#8211; Stock Cooperative: The \u201cseparate interest\u201d is the exclusive right to occupy a<\/p>\n<p>portion of the real property, the title to which is held by the corporation. Members of stock<\/p>\n<p>cooperatives are issued a stock certificate at the close of escrow. A landlord-tenant relationship exists<\/p>\n<p>between the corporation and the members (shareholders).<\/p>\n<p>Common Area (Condominiums) &#8211; All areas are controlled and administered by the corporation<\/p>\n<p>exclusive of the units.<\/p>\n<p>Common Area (Co-Ops) &#8211; All real property exclusive of the units.<\/p>\n<p>Page 2 of 7<br \/>\nLimited-Use Common Area &#8211; Portions of the condominium or stock cooperative project that are not<\/p>\n<p>within the defined boundaries of a unit, but are intended to be used exclusively by one owner.<\/p>\n<p>Examples of limited-use common area are garages, patios, balconies and carports.<\/p>\n<p>United Laguna Woods Mutual is stock cooperative housing comprised of 6,323 memberships. Its<\/p>\n<p>governing documents include articles of incorporation, bylaws, occupancy agreement and operating<\/p>\n<p>rules. The corporation leadership consists of an 11-member board of directors, elected by the<\/p>\n<p>members of United Mutual. United operates and maintains the units, laundry rooms, carports and<\/p>\n<p>common grounds owned by the corporation. The corporation also owns the unaltered interior fixtures<\/p>\n<p>in the unit, including the appliances.<\/p>\n<p>Third Laguna Hills Mutual is condominium housing comprised of 6,102 memberships. Its governing<\/p>\n<p>documents include articles of incorporation; bylaws; covenants, conditions and restrictions (CC&amp;Rs);<\/p>\n<p>and operating rules. The corporation leadership consists of an 11-member board of directors, elected<\/p>\n<p>by the members of Third Mutual. All units built in the community since 1968 are condominiums. Third<\/p>\n<p>Mutual operates and maintains the buildings, laundry rooms, carports and grounds.<\/p>\n<p>Laguna Woods Mutual No. Fifty is a condominium association comprised of 311 memberships. Its<\/p>\n<p>governing documents include articles of incorporation, bylaws, and CC&amp;Rs. The corporation leadership<\/p>\n<p>consists of a five-member board of directors, elected by the members of Mutual No. Fifty. Their<\/p>\n<p>property management is separate from VMS Inc.<\/p>\n<p>Mutual No. Fifty consists of two high-rise buildings located inside Gate 10 at 24055 Paseo del Lago<\/p>\n<p>West. Weekly housekeeping is offered at no extra cost. Dinner is included in monthly fees. Room<\/p>\n<p>service and carry-out lunch are also available at an extra cost. The<\/p>\n<p>sublease permit and lodger room rental applications are renewable annually. If a member rents out a room<\/p>\n<p>to a lodger, only one lodger is permitted per unit, which must be occupied by the member. In Third Mutual<\/p>\n<p>(condos), units may be leased or a member can rent out a portion of the unit for a minimum of 30<\/p>\n<p>days up to 12 months. The lease\/rental authorization is renewable annually. If a member rents out a<\/p>\n<p>portion of the unit, the member must reside in the unit with the tenant. Mutual No. Fifty requires a 30-<\/p>\n<p>day minimum lease period and does not have a maximum lease term limit. Any person wishing to<\/p>\n<p>reside in the community must first obtain approval from the board of directors for that specific<\/p>\n<p>corporation.<\/p>\n<p>Local realty offices or individual members are responsible for obtaining any lease, sublease or room<\/p>\n<p>rental agreement between landlord and tenant. All (sub)lease and room rental applications are<\/p>\n<p>processed by the Community Services Division at the Laguna Woods Village Community Center,<\/p>\n<p>located at 24351 El Toro Road. Processing includes annual fees, submittal of an application to the<\/p>\n<p>board for approval and the issuance of resident ID cards.<\/p>\n<p>Q: What is the monthly assessment fee?<\/p>\n<p>A: Monthly assessments (carrying charges) vary among dwelling units, each depending on the mutual<\/p>\n<p>and building amenities, such as common-area laundries and elevators. Assessments include shared<\/p>\n<p>costs for exterior maintenance, landscaping, some utilities, security, broadband, bus transportation,<\/p>\n<p>mutual insurance and recreational activities. Over our history, Laguna Woods Village has never charged<\/p>\n<p>special assessment fees.<\/p>\n<p>Q: What is meant by cooperative housing?<\/p>\n<p>A: Cooperative housing is a real property housing project solely owned by the corporation and formed<\/p>\n<p>with the intent that members\/shareholders shall have the right to occupy the dwelling units through<\/p>\n<p>executing an occupancy agreement, which is similar to a lease between the member and corporation.<\/p>\n<p>Upon approval of the board of directors, qualified members become owners of a stock certificate that<\/p>\n<p>entitles them to reside in the unit.<\/p>\n<p>Q: When was the community built?<\/p>\n<p>A: The community was built in phases between 1963 and 1985. The first property was sold in January<\/p>\n<p>1964; the first move-in was September 10, 1964.<\/p>\n<p>Q: Are there any medical facilities onsite?<\/p>\n<p>A: No; however, there are numerous facilities in the immediate area, which are accessible via the GRF<\/p>\n<p>bus system, including MemorialCare Saddleback Medical Center. Three other hospitals are nearby, as<\/p>\n<p>well.<\/p>\n<p>Page 5of 7<br \/>\nQ: Are pets permitted in the community?<\/p>\n<p>A: Pets are permitted; however, the community complies with the City of Laguna Woods Animal<\/p>\n<p>Control rules and requires that residents be able to maintain their pets in accordance with these rules.<\/p>\n<p>Each housing mutual also has its own pet policies which can be found on the website at<\/p>\n<p>lagunawoodsvillage.com.<\/p>\n<p>Q: Are guests permitted in the community?<\/p>\n<p>A: Yes, guests are permitted to visit community residents. The governing documents state that<\/p>\n<p>overnight guest visitations are limited to 60 days (cumulative) in a 12-month period, in accordance<\/p>\n<p>with \u00a751.3 of the California Civil Code. Guests may not reside in a unit in the absence of the qualified<\/p>\n<p>resident. Guests are also welcome at various Village events, dinners and pool events when<\/p>\n<p>accompanied by a resident member.<\/p>\n<p>Q: Are transportation services available within the community?<\/p>\n<p>A: Yes, the Transportation Division provides free fixed-route and limited-demand response bus service<\/p>\n<p>for all residents and their guests within the community and the immediate surrounding area outside of<\/p>\n<p>the community. Service is provided to adjacent medical offices, MemorialCare Saddleback Medical<\/p>\n<p>Center, supermarkets, financial institutions and many small businesses surrounding the community.<\/p>\n<p>Fixed-route bus service is provided Monday through Friday from 9 a.m. to 5 p.m. Journey scheduled<\/p>\n<p>ride service is for preapproved riders with medical needs. In addition, the Village has partnered with<\/p>\n<p>Lyft rideshare service to offer rides to residents within the transportation system parameter range<\/p>\n<p>Monday through Friday from 7 to 9 a.m. and from 5 to 10 p.m., Saturdays from 7 a.m. to 10 p.m. and<\/p>\n<p>Sundays from 7 a.m. to 5 p.m.<\/p>\n<p>Q: Upon the death of an owner, what happens to his\/her dwelling unit?<\/p>\n<p>A: Generally, in Third Mutual (condos), ownership may pass to the heir as with any property. However,<\/p>\n<p>in United Mutual (co-ops), the answer depends on how the title is held and is a question that may be<\/p>\n<p>best answered by legal counsel. The mutuals\u2019 boards of directors must approve any sale or transfer of<\/p>\n<p>membership. The Community Services Division can provide general information and assistance.<\/p>\n<p>Q: Is there a cost to use the recreation facilities, other than the monthly fee?<\/p>\n<p>A: Most recreational activities, facilities and services are included in the monthly assessment, with the<\/p>\n<p>exception of the golf course and equestrian center, which charge nominal \u201cuser\u201d fees. Small fees are<\/p>\n<p>charged for movies, special dinner and recreation events, special cultural events, garden center plots<\/p>\n<p>and recreational vehicle storage areas.<\/p>\n<p>Q: What is the minimum age to move into the Community?<\/p>\n<p>A: In accordance with \u00a751.3 of the California Civil Code, effective January 1, 1985, at least one person<\/p>\n<p>occupying a unit must be 55 years of age to qualify for occupancy. Co-occupants must be at least 45<\/p>\n<p>years of age. Certain exceptions are permitted under the law.<\/p>\n<p>Q: Can you purchase for investment purposes if you are under 55 years of age?<\/p>\n<p>A: To purchase in Third Mutual (condos), the buyer must be of legal age to sign a contract and qualify<\/p>\n<p>Page 6 of 7<br \/>\nfor membership. Some units in Third Mutual have two-car<\/p>\n<p>garages.
