Policy for Alteration of Soffits and Suspended Ceilings<\/p>\n
WHEREAS,<\/p>\n
the Board of Directors of United Laguna Woods<\/p>\n
Mutual<\/p>\n
(\u201cBoard\u201d)<\/p>\n
established policies and procedures for the<\/p>\n
construction of any alterations, additions and expansions; and<\/p>\n
WHEREAS, the Board, through Resolution 01-17-94, adopted and<\/p>\n
implemented the Revised Land Use Policy which prohibits the Board<\/p>\n
from granting use of common area for alterations;<\/p>\n
WHEREAS, the Davis-Stiring Common Interest Development Act<\/p>\n
(\u201cAct\u201d) defines the area above the interior surface of a unit as<\/p>\n
common area and Staff receives numerous requests for alterations<\/p>\n
to remove suspended ceilings and soffits which, if done, would<\/p>\n
encroach into this common area;<\/p>\n
WHEREAS, the Board has consulted with Staff and legal counsel and<\/p>\n
determined that the Act permits the granting of exclusive use of use of<\/p>\n
common area that is generally inaccessible and not of general use to<\/p>\n
transfers<\/p>\n
\u8fd9<\/p>\n
the membership at<\/p>\n
large and<\/p>\n
responsibility of<\/p>\n
maintenance and management to the Shareholder; and<\/p>\n
WHEREAS,<\/p>\n
the Board has determined<\/p>\n
that the area above<\/p>\n
suspended ceilings and soffits meets these requirements.<\/p>\n
NOW THEREFORE, BE IT RESOLVED, June 12, 2018, that the<\/p>\n
Board<\/p>\n
\u7684<\/p>\n
Directors hereby adopts the following Resolution for<\/p>\n
establishment of the Policy for Alteration of Soffits and Suspended<\/p>\n
Ceilings;<\/p>\n
RESOLVED FURTHER, an alteration which removes suspended<\/p>\n
ceilings and soffits that does not negatively affect structural members<\/p>\n
or the structural soundness of the structures that meets the criteria set<\/p>\n
forth in the United Architectural Review Procedures may be approved<\/p>\n
by Staff through the Mutual Consent process;<\/p>\n
RESOLVED FURTHER, any such alteration, with the exception of<\/p>\n
alterations permitted by existing and future Mutual Standards, shall
\nnot include any alteration of the structural members or protrude or<\/p>\n
affect any space above the lowest part of the structural members; and,<\/p>\n
RESOLVED FURTHER,<\/p>\n
that the officers and agents of this<\/p>\n
Corporation are hereby authorized on behalf of the Corporation to<\/p>\n
