United is a cooperative where each shareholder\/member is granted the right to occupy a<\/p>\n<p>specific unit under the terms of each Occupancy Agreement together with ownership of one share in the<\/p>\n<p>cooperative. The resale process differs from a condominium, and this package is to assist you in the<\/p>\n<p>process.<\/p>\n<p>This package contains key information that the seller, potential buyer and real estate\/escrow company<\/p>\n<p>should know. To ease the process, a document checklist has been created for each.<\/p>\n<p>Before you get started, ensure that the potential buyer meets the qualifications to own a share of stock<\/p>\n<p>and reside in United. The prospective buyer must meet the following requirements:<\/p>\n<p>o Age restriction (be at least 55 years of age);<\/p>\n<p>[m]<\/p>\n<p>Financial qualifications:<\/p>\n<p>o Assets equal to the purchase price of the unit plus $125,000;<\/p>\n<p>[\u00a2]<\/p>\n<p>Income of at least $40,000 per year at the time of purchase (for more information refer to the<\/p>\n<p>financial qualifications policy found on the Laguna Woods Village website under Sales); and<\/p>\n<p>o You may not own or be listed on more than one certificate.<\/p>\n<p>If all of the above conditions are met, proceed with familiarizing yourself with the key definitions in this<\/p>\n<p>package and submit the required documents for review by the United Board of Directors (board). GRF oversees the community facilities and services, including recreational<\/p>\n<p>facilities and amenities.<\/p>\n<p>Governing documents \u2014 All of the following, collectively: the articles of incorporation, bylaws;<\/p>\n<p>Occupancy Agreements, rules and regulations, and any resolutions or policies of the board; all the<\/p>\n<p>same may be lawfully amended or modified from time to time.<\/p>\n<p>Identification (ID) card \u2014 Photo ID card issued by GRF to shareholders\/members, co-occupants and<\/p>\n<p>sublessees of the community authorizing use and access to the community facilities.<\/p>\n<p>Shareholder\/Member &#8211; Entitled to membership in United and approved by the board of directors to<\/p>\n<p>exclusively occupy a unit and to whom a stock and\/or membership certificate of the corporation has<\/p>\n<p>been issued. Decisions will be based<\/p>\n<p>on verified facts rather than a perceived threat.<\/p>\n<p>United Mutual will not use criminal background reports to obtain or consider information relating<\/p>\n<p>to race, color, religion, sex, familial status, national origin, sexual orientation, marital status,<\/p>\n<p>ancestry, source of income or disability to evaluate the applicant. Information will be used only<\/p>\n<p>to evaluate the applicant&#8217;s housing request. All items noted<\/p>\n<p>as corrections on the final inspection report must be completed prior to the close of escrow.<\/p>\n<p>Issuance of service orders<\/p>\n<p>Service orders will be entered for all items of work noted in the corrections report for which the mutual is<\/p>\n<p>responsible. Member\u2019s Right to Peaceable Possession<\/p>\n<p>authorized occupants and abides by the terms of this<\/p>\n<p>In return for the Member&#8217;s continued fulfillment of the terms<\/p>\n<p>Occupancy Agreement. The Member shall not permit or<\/p>\n<p>and conditions of this Occupancy Agreement, the Member<\/p>\n<p>suffer anything to be done or kept in or about the dwelling<\/p>\n<p>may have and enjoy for his sole use and benefit the dwelling<\/p>\n<p>unit or other premises of the Corporation which will increase<\/p>\n<p>unit hereinabove described, after obtaining occupancy. If the<\/p>\n<p>the rate of insurance on any building or other property of the<\/p>\n<p>Member for any reason shall cease to be an occupant of the<\/p>\n<p>Corporation or on the contents thereof or which will obstruct<\/p>\n<p>dwelling unit other than during occupancy by a non-Member<\/p>\n<p>or interfere with the rights of other members of the<\/p>\n<p>occupant approved by the Corporation in writing, the Member<\/p>\n<p>shall surrender to the Corporation possession thereof.<\/p>\n<p>Corporation or annoy them by unreasonable noises or<\/p>\n<p>otherwise nor will it commit or permit any nuisance in or<\/p>\n<p>about the dwelling unit or other premises of the Corporation<\/p>\n<p>Article 7. Subletting Conditionally Permitted<\/p>\n<p>or commit or suffer any immoral or illegal act to be<\/p>\n<p>The Member shall not assign this Occupancy Agreement or<\/p>\n<p>committed thereon. The Member shall comply with all of the<\/p>\n<p>sublet this dwelling unit without the prior written consent<\/p>\n<p>requirements of governmental authorities with respect to the<\/p>\n<p>of the Corporation. Rents under any sublease may be<\/p>\n<p>dwelling unit and all other premises of the Corporation. Management, Taxes and Insurance<\/p>\n<p>(b) By Corporation. The Corporation shall provide and pay<\/p>\n<p>The Corporation shall provide necessary management,<\/p>\n<p>for all necessary repairs, maintenance and replacements,<\/p>\n<p>operation and administration; pay or provide for the payment<\/p>\n<p>except as specified in clause (a) of this Article, including but<\/p>\n<p>of all taxes or assessments levied against assets of the<\/p>\n<p>not limited to unaltered kitchen and bath floors and<\/p>\n<p>Corporation, procure and pay or provide for the payment of<\/p>\n<p>countertops. The officers and agents of the Corporation shall<\/p>\n<p>fire insurance, extended coverage and other insurance as<\/p>\n<p>have the right to enter the dwelling unit of the Member in<\/p>\n<p>required by any mortgage on property of the Corporation and<\/p>\n<p>order to effect necessary repairs, maintenance, and<\/p>\n<p>such other insurance as the Corporation may deem<\/p>\n<p>replacements, and to authorize entrance for such purposes<\/p>\n<p>advisable. The Corporation shall not provide insurance on<\/p>\n<p>by employees of any contractor, utility company, municipal<\/p>\n<p>the Member&#8217;s interest in the dwelling unit or on the Member&#8217;s<\/p>\n<p>agency, or others, at any reasonable hour of the day and in<\/p>\n<p>personal property. The Member shall reimburse the<\/p>\n<p>the event of emergency at any time.<\/p>\n<p>Corporation for the portion of real property taxes and<\/p>\n<p>(c) Right of Corporation to make repairs at Member&#8217;s<\/p>\n<p>assessments attributable to the Member&#8217;s dwelling unit.<\/p>\n<p>expense.<\/p>\n<p>In case the Member shall fail to effect the repairs,<\/p>\n<p>Article 10. Alterations and Additions<\/p>\n<p>2)<\/p>\n<p>Any redecoration of the interior of the dwelling unit;<\/p>\n<p>The Member shall not make any structural alterations to the<\/p>\n<p>and<\/p>\n<p>interior or exterior of the dwelling unit or to any pipes,<\/p>\n<p>3)<\/p>\n<p>Any repairs or maintenance on any air conditioner<\/p>\n<p>electrical conduits, plumbing or other fixtures connected<\/p>\n<p>installed in the dwelling unit; and<\/p>\n<p>therewith, or remove any additions, improvements, or<\/p>\n<p>4)<\/p>\n<p>Any maintenance, repairs and replacements of<\/p>\n<p>fixtures from the dwelling unit without prior written consent of<\/p>\n<p>appliances within the interior of the dwelling unit<\/p>\n<p>the Corporation. The Member shall not install or use in the<\/p>\n<p>(including, but not limited to, refrigerators, cook tops,<\/p>\n<p>dwelling unit, any air conditioning equipment, washing<\/p>\n<p>hoods and ovens), and any cabinet<\/p>\n<p>machine, clothes dryer, electric heater, or power tools<\/p>\n<p>modifications\/alterations and other upgrades related<\/p>\n<p>without prior written consent of the Corporation. The Member<\/p>\n<p>to the installation of those appliances, that are<\/p>\n<p>shall remove any such equipment promptly upon request of<\/p>\n<p>designated as the responsibility of the Member<\/p>\n<p>the Corporation.<\/p>\n<p>under the Corporation\u2019s \u201cAppliance Policies\u201d<\/p>\n<p>Any alterations, additions, fixtures or improvements installed<\/p>\n<p>adopted on March 11, 2003, as may be amended<\/p>\n<p>by the Member or any predecessor of the Member, whether<\/p>\n<p>from time to time; and<\/p>\n<p>within or without the dwelling unit, shall be repaired or<\/p>\n<p>5)<\/p>\n<p>Any repairs or maintenance of all fixtures and other<\/p>\n<p>maintained by the Member at its own expense and in a<\/p>\n<p>items within the interior surfaces of the perimeter<\/p>\n<p>manner satisfactory to the Corporation. If the Member should<\/p>\n<p>walls, floors and ceilings of the dwelling unit that are<\/p>\n<p>fail to do so, such repairs or maintenance may be performed<\/p>\n<p>designated as the responsibility of the Member<\/p>\n<p>by the Corporation and upon demand by the Corporation,<\/p>\n<p>under the Corporations \u201cSummary of Chargeable<\/p>\n<p>the Member shall reimburse the Corporation therefor<\/p>\n<p>forthwith.<\/p>\n<p>Maintenance Services\u201d adopted on June 12, 2007,<\/p>\n<p>as may be amended from time to time; and<\/p>\n<p>6)<\/p>\n<p>Any repairs or maintenance of alterations and<\/p>\n<p>Article 13. Default by Member<\/p>\n<p>invoke any remedy allowed by law or in equity as if re-entry,<\/p>\n<p>If at any time after the happening of any of the events<\/p>\n<p>summary proceedings, and other remedies were not herein<\/p>\n<p>specified in clauses (a) to (h) of this Article, the Corporation<\/p>\n<p>provided for.<\/p>\n<p>shall give to the Member a notice that its rights under this<\/p>\n<p>The Member expressly agrees that there exists under this<\/p>\n<p>Occupancy Agreement will expire at a date not less than<\/p>\n<p>Occupancy Agreement a landlord-tenant relationship and that<\/p>\n<p>ten (10) days thereafter, all of the Member&#8217;s rights under<\/p>\n<p>in the event of a breach or threatened breach of any<\/p>\n<p>this Occupancy Agreement will expire on the date so fixed in<\/p>\n<p>covenant or provision of this Occupancy Agreement by the<\/p>\n<p>such notice, unless in the meantime the default has been<\/p>\n<p>Member, or non-Member occupant of the dwelling unit, or any<\/p>\n<p>cured in a manner deemed satisfactory by the Corporation,<\/p>\n<p>guest or invitee of the Member or such non-Member<\/p>\n<p>it being the intention of the parties hereto to create hereby<\/p>\n<p>occupant of the dwelling unit, there shall be available to the<\/p>\n<p>conditional limitations, and it shall thereupon be lawful for<\/p>\n<p>Corporation such legal remedy or remedies as are available<\/p>\n<p>the Corporation to re-enter the dwelling unit and to remove<\/p>\n<p>to a landlord under the laws of the State of California for the<\/p>\n<p>all persons and personal property therefrom, either by<\/p>\n<p>breach or threatened breach by a tenant of any provision of a<\/p>\n<p>summary dispossession proceedings or by suitable action or<\/p>\n<p>lease or rental agreement. The Member hereby waives any<\/p>\n<p>proceeding at law or in equity or by any other proceedings<\/p>\n<p>and all notices and demands for possession as provided by<\/p>\n<p>the laws of the State of California.<\/p>\n<p>which may apply to the eviction of tenants, and to repossess<\/p>\n<p>the dwelling unit in its former state:<\/p>\n<p>a)<\/p>\n<p>If at any time during the term of this Occupancy<\/p>\n<p>Article 15. The failure to<\/p>\n<p>first mortgage or deed of trust and the accompanying<\/p>\n<p>exercise any right or remedy available to the Corporation for<\/p>\n<p>documents executed to secure the principal sum, to any and<\/p>\n<p>any breach of this Occupancy Agreement by the Member shall<\/p>\n<p>all modifications, extensions and renewals of such loans, to<\/p>\n<p>not be deemed to be a waiver of any of its rights or remedies in<\/p>\n<p>any mortgage or deed of trust made in replacement of such<\/p>\n<p>the event of any other breach by the Member.<\/p>\n<p>mortgage or deed of trust and to such additional loans or<\/p>\n<p>advances as may thereafter be made by or borrowed from the<\/p>\n<p>Article 23. Late Charges and Attorney\u2019s Fees<\/p>\n<p>beneficiary, its successors or assigns, together with interest<\/p>\n<p>The Member covenants and agrees that, in addition to the<\/p>\n<p>other sums that have become or will become due pursuant to<\/p>\n<p>thereon, and to any mortgages or deeds of trust, consolidation<\/p>\n<p>agreements and other accompanying documents given to<\/p>\n<p>the terms of this Occupancy Agreement, the Member shall pay<\/p>\n<p>secure any such additional loan or advances which may at<\/p>\n<p>to the Corporation a late charge in an amount determined by<\/p>\n<p>any time hereafter be placed on the real property of the<\/p>\n<p>the Corporation, reasonable costs of collection and interest at a<\/p>\n<p>Corporation, or any part thereof. The Member hereby agrees<\/p>\n<p>rate determined by the Corporation for each payment of<\/p>\n<p>to execute, at the Corporation&#8217;s request and expense, any<\/p>\n<p>Carrying Charges or part thereof not paid within 15 days after<\/p>\n<p>instrument which the Corporation or any lender may deem<\/p>\n<p>the date payment is due.<\/p>\n<p>necessary or desirable to effect the subordination of this<\/p>\n<p>If the Member shall default in making payments of any sum<\/p>\n<p>Occupancy Agreement to any such mortgage or deed of trust,<\/p>\n<p>payable to the Corporation of if the Member, any non-Member<\/p>\n<p>and the Member herby appoints the Corporation and each<\/p>\n<p>occupant of the dwelling unit, or any guest or invitee of the<\/p>\n<p>and every officer thereof, and any future officer, such<\/p>\n<p>Member or such non-Member occupant of the dwelling unit<\/p>\n<p>Member&#8217;s attorney-in-fact during the term hereof to execute<\/p>\n<p>defaults in the performance of any of their respective<\/p>\n<p>any such instrument on behalf of the Member. The Member<\/p>\n<p>obligations under this Occupancy Agreement, and the<\/p>\n<p>hereby expressly waives any and all notices of default and<\/p>\n<p>Corporation has obtained the services of an attorney with<\/p>\n<p>notices of foreclosure of said mortgage and deed of trust<\/p>\n<p>respect to any such default, the Member shall pay to the<\/p>\n<p>which may be required by law. [] Yes [] No<\/p>\n<p>United Resale Package<\/p>\n<p>Page 41 of 44<\/p>\n<p>Rev 1-1-2026<br \/>\nUNITED LAGUNA WOODS<\/p>\n<p>MUTUAL\u2014<\/p>\n<p>Application for Co-occupancy Permit \u2014 Page 2<\/p>\n<p>Primary rules governing occupancy \u2014 United Laguna Woods Mutual<\/p>\n<p>The parties to this agreement are the mutual corporation, hereinafter referred to as \u201cthe mutual\u201d; the member(s),<\/p>\n<p>hereinafter referred to as \u201cshareholder,\u201d and whose signature appears on the reverse side of this application; and the<\/p>\n<p>applicant(s) for occupancy, hereinafter referred to as \u201cco-occupant,\u201d and whose signature appears on the reverse side<\/p>\n<p>of this application. In consideration of their mutual undertakings, and by executing this application, the parties hereto<\/p>\n<p>agree as follows:<\/p>\n<p>1<\/p>\n<p>Co-occupant(s) shall be entitled to occupy the unit indicated on the reverse side of this application.<\/p>\n<p>2<\/p>\n<p>Co-occupant(s) and shareholder(s) affirm their intent that the co-occupant will reside in this unit and that<\/p>\n<p>occupant is 45 years of age or older, or is the spouse or registered domestic partner of the qualifying resident, or<\/p>\n<p>is a disabled child\/grandchild.<\/p>\n<p>Non-shareholders may reside only if they are approved to co-occupy (and meet the requirements of Section 2<\/p>\n<p>above), and reside with a qualifying member who is at least 55 years of age.<\/p>\n<p>Co-occupant(s) shall be entitled to the use and enjoyment of the facilities and services provided by the Golden<\/p>\n<p>Rain Foundation on the same basis as shareholders of the foundation, but will have neither ownership nor voting<\/p>\n<p>rights in the foundation or any mutual.<\/p>\n<p>Shareholder shall be responsible for the conduct and deportment of the co-occupant.<\/p>\n<p>Co-occupant shall be subject to the same rules, regulations and restrictions (and of the Occupancy Agreement in<\/p>\n<p>United Mutual) that are applicable to the shareholder, except with respect to payment of carrying charges. If co-<\/p>\n<p>occupant ever shall become the legal or equitable owner of the membership, co-occupant will apply for<\/p>\n<p>membership in the mutual (and will execute an Occupancy Agreement in United Mutual) in the form generally<\/p>\n<p>used by the mutual and will pay all amounts due pursuant to the Occupancy Agreement.<\/p>\n<p>Shareholder and co-occupant shall be equally responsible for payment of any charges incurred by co-occupant in<\/p>\n<p>respect to service provided by the Golden Rain Foundation or the mutual.<\/p>\n<p>Shareholder agrees to pay to the mutual an additional sum each month for each occupant of the unit in excess of<\/p>\n<p>two, at the rate prescribed by the mutual and\/or GRF.<\/p>\n<p>Shareholders shall be responsible for canceling the co-occupancy status and returning co-occupant\u2019s ID card<\/p>\n<p>when co-occupant ceases to reside in the unit, or charges will incur.<\/p>\n<p>10<\/p>\n<p>Any party may terminate this agreement at any time upon 30 days written notice to the other parties to this<\/p>\n<p>agreement.<\/p>\n<p>1&#8221;<\/p>\n<p>In order to induce the mutual to execute this agreement, the other parties agree that they have no rights against<\/p>\n<p>the mutual as a direct or indirect result of the execution of this agreement, and in the event that there are any<\/p>\n<p>expenses incurred by the mutual to enforce the terms of this agreement, or to remove or take other action, or to<\/p>\n<p>defend any action relative to shareholder or co-occupant, as a direct or indirect result of this agreement,<\/p>\n<p>shareholder and co-occupant agree to hold the mutual harmless from and to pay all costs or expenses incurred<\/p>\n<p>by the mutual, including, but not limited to, attorney\u2019s fees, court costs or related expenses.<\/p>\n<p>12<\/p>\n<p>Co-occupant(s) affirm that they have not been convicted of a felony within the past 20 years, or a misdemeanor<\/p>\n<p>involving moral turpitude within the past five years.<\/p>\n<p>13<\/p>\n<p>Guests may stay a maximum of 60 days per year, and only while the qualifying senior resident is in<\/p>\n<p>residence.<\/p>\n<p>Notice to shareholders and applicants<\/p>\n<p>Approval of this application by the mutual, in and of itself, does not confer any right on the co-occupant other than the<\/p>\n<p>revocable right to occupy the unit named on the reverse of this form. As indicated, both shareholder and the mutual<\/p>\n<p>generally have the right to terminate occupant status at any time, without cause, provided, however, that Section 51.3<\/p>\n<p>of the California Civil Code may be interpreted to inhibit this right of termination in certain circumstances.<\/p>\n<p>United Resale Package<\/p>\n<p>Page 42 of 44<\/p>\n<p>Rev 1-1-2026<br \/>\nDisclosure notice: Asbestos-containing construction materials<\/p>\n<p>es<\/p>\n<p>~~<\/p>\n<p>Laguna Woods Village<\/p>\n<p>Notice<\/p>\n<p>To<\/p>\n<p>Employees, contractors employed by the Laguna Woods Village<\/p>\n<p>associations, members and prospective purchasers of dwelling units at<\/p>\n<p>Laguna Woods Village, Laguna Woods<\/p>\n<p>From:<\/p>\n<p>Village Management Services Inc.<\/p>\n<p>Subject:<\/p>\n<p>Disclosure notice: Laguna Woods Village buildings constructed with<\/p>\n<p>asbestos-containing construction materials<\/p>\n<p>Health &#038; Safety Code 25915.2 and 25915.5 require the mutual to provide annual notice about the<\/p>\n<p>existence of asbestos-containing materials (ACM) in nonresidential public buildings in the mutual<\/p>\n<p>to all employees and contractors performing work within said buildings, and to all members of the<\/p>\n<p>mutual.<\/p>\n<p>In addition, the mutual is required to disclose to new owners, within 15 days of acquiring title to a<\/p>\n<p>unit, the existence of asbestos-containing material in nonresidential public buildings within the<\/p>\n<p>mutual.<\/p>\n<p>Village Management Services Inc., as employer, and as agent, for the associations that own or<\/p>\n<p>manage the buildings at Laguna Woods Village, Laguna Woods, for their members, hereby<\/p>\n<p>notifies all its employees, contractors and all mutual members and transferees, that some<\/p>\n<p>buildings within Laguna Woods Village have been surveyed and found to contain asbestos.<\/p>\n<p>The analytical method used to determine asbestos content was polarized light<\/p>\n<p>microscopy\/dispersion staining. Since the community has an active asbestos operations and<\/p>\n<p>maintenance program, testing is ongoing. Because of the high cost to conduct a complete<\/p>\n<p>asbestos survey and analysis of all buildings, surveys are conducted only upon repair, remodel,<\/p>\n<p>addition to or removal of a building or part of a building suspected to contain asbestos materials,<\/p>\n<p>as required by labor codes. The certificates of analysis for any testing received to date are<\/p>\n<p>available to employees, contractors, owners and tenants and transferees for review and<\/p>\n<p>photocopying from the Laguna Woods Village Human Resources\/Safety Office, 24351 El Toro<\/p>\n<p>Road, Laguna Woods, CA., between 9 a.m. and 5 p.m., Monday through Friday.<\/p>\n<p>The following buildings in Laguna Woods Village, Laguna Woods, were constructed prior to<\/p>\n<p>1979 and thus may contain asbestos in one or more construction materials: All community<\/p>\n<p>facilities buildings (with the exception of Clubhouse 7, the mini-gym at Clubhouse 1, the<\/p>\n<p>broadband services building, the Laguna Woods Village Community Center, the vehicle<\/p>\n<p>maintenance building, and a portion of the warehouse\u2014all constructed after 1979), including<\/p>\n<p>clubhouses and outbuildings, library, maintenance warehouse building, stables, gatehouses,<\/p>\n<p>garden center buildings, all detached laundry buildings and residential buildings numbers 1<\/p>\n<p>through 5543 inclusive.<\/p>\n<p>Disclosure notice: Asbestos-containing construction materials continued on next page<\/p>\n<p>United Resale Package<\/p>\n<p>Page 43 of 44<\/p>\n<p>Rev 1-1-2026<br \/>\nAt the time most of the buildings in Laguna Woods Village were constructed, asbestos-containing<\/p>\n<p>materials met local codes as well as state and federal regulations and were extensively used in<\/p>\n<p>many building products, including but not limited to: ceiling tile, floor tile\/linoleum and mastic,<\/p>\n<p>textured wall surfaces, sprayed acoustical ceilings, fire doors, structural fireproofing, pipe\/boiler<\/p>\n<p>insulation, attic insulation and heating duct material\/insulation.<\/p>\n<p>According to the National Cancer Institute and the Environmental Protection Agency, any<\/p>\n<p>asbestos in these materials does not present a threat to health so long as the asbestosis not<\/p>\n<p>disturbed and does not become airborne.<\/p>\n<p>However, because breathing asbestos has been known in some instances to cause cancer and<\/p>\n<p>other forms of lung disease, sanding, scraping, drilling, sawing, crushing, tearing\/breaking up or<\/p>\n<p>otherwise disturbing asbestos-containing materials presents a potential health risk. Therefore,<\/p>\n<p>you are directed not to perform such tasks in areas with ACM present or suspected unless the<\/p>\n<p>area\/materials have been tested and found not to contain asbestos or if specifically assigned or<\/p>\n<p>contracted to do such work and it is in accordance with all federal, state, and local laws as well<\/p>\n<p>as internal guidelines called for in the asbestos operations and maintenance plan and other<\/p>\n<p>company safety and environmental policies and procedures.<\/p>\n<p>Village Management Services Inc. employees whose work orders require them to construct,<\/p>\n<p>repair, maintain or otherwise disturb construction materials that may contain asbestos are<\/p>\n<p>hereby directed to follow the current regulations and policies noted above and to wear the<\/p>\n<p>required protective equipment, prior to performing such work.
