SUBJECTS: 1.) Third Mutual Barbecue Grill Rules and Regulations Rescinded, and<\/p>\n
2.) Revised Third Alteration Fee Schedule<\/p>\n
On September 19, 2023, the Third Mutual board of directors adopted two resolutions that may<\/p>\n
impact buyers and sellers. The two resolutions are as follows:<\/p>\n

By way of Resolution 03-23-109, Third Mutual rescinded its barbecue grill rules and<\/p>\n
regulations because the board determined they were too constricting to members.<\/p>\n
By way of Resolution 03-23-111, Third Mutual amended its alteration fee schedule to better<\/p>\n
align the fees with the administrative time it takes to process mutual consent applications<\/p>\n
and variances. See the new resolution below:<\/p>\n
RESOLUTION 03-23-111<\/p>\n
Alteration Fee Schedule<\/p>\n
WHEREAS, alteration and variance requests require significant staff time for proper<\/p>\n
processing, including research, report preparation, presentation to the appropriate<\/p>\n
committee and Board; and<\/p>\n
WHEREAS, in order to offset a portion of the administrative costs associated with<\/p>\n
processing alteration applications, the Board has adopted an Alterations Fee Schedule;<\/p>\n

WHEREAS, the attached revisions to the Alteration Fee Schedule are recommended to<\/p>\n
be approved by the Board; and<\/p>\n
WHEREAS, the new Alteration Fee Schedule better aligns the fees with the<\/p>\n
administrative time it takes to process each task;<\/p>\n
NOW THEREFORE BE IT RESOLVED, September 19, 2023, that the Board hereby<\/p>\n
adopts the revised Alteration Fee Schedule as attached to the official minutes of this<\/p>\n
meeting and this resolution; and

RESOLVED FURTHER, that the following sections from prior resolutions remain valid:<\/p>\n
(1<\/p>\n
The mutual consent processing fee for Solar Panel installation is to be calculated<\/p>\n
based on 4.7 hours charged at the current bill rates; and the mutual consent processing<\/p>\n
fee for Solar Panel installation requests is set at the initial rate of $223 for 2023 and will<\/p>\n
be adjusted annually with the adoption of the new bill rates; and<\/p>\n
(2<\/p>\n
The approval of variances for the use of common areas that extend beyond the<\/p>\n
original floorplan and that meet the requirements of Civil Code Section 4600, requires<\/p>\n
the execution and recordation of a Recordable Exclusive Use of Common Area<\/p>\n
Revocable License; that a flat legal fee of $750 for the preparation of these agreements<\/p>\n
as a pass-through charge to the Mutual’s legal team is adopted; and the processing of<\/p>\n
agreements for all other approved variances, including exclusive use common area as<\/p>\n
recognized within the footprint of the property, will utilize a Counsel-prepared and<\/p>\n
approved boilerplate form at no additional charge to the member;<\/p>\n
RESOLVED FURTHER, that Resolution 03-23-43 adopted April 18, 2023 and Resolution<\/p>\n
03-23-69 adopted June 20, 2023 are hereby superseded and canceled; and<\/p>\n
RESOLVED FURTHER, that future revisions to the Alteration Fee Schedule will be<\/p>\n
included with the Annual Assessment Letter Packet that the Finance Department issues<\/p>\n
every year in November under the Architectural Review Procedures section of the Annual<\/p>\n
Policy Statement; and<\/p>\n
RESOLVED FURTHER, that the officers and agents of this Corporation are hereby<\/p>\n
authorized on behalf of the Corporation to carry out the resolution.<\/p>\n
