Before an elevator\/platform lift can be installed onto mutual property, the<\/p>\n
following requirements must be agreed to by the requesting member(s) and<\/p>\n
his\/her mutual:<\/p>\n
Pre Construction<\/p>\n
1<\/p>\n
Members with a verifiable disability may request an installation of an<\/p>\n
elevator\/platform lift.<\/p>\n
The requesting member shall pay all costs associated with the<\/p>\n
installation including but not limited to professional fees,<\/p>\n
preconstruction site assessment and construction costs.<\/p>\n
A nonrefundable deposit (except as set forth below) in the amount of<\/p>\n
$6,000.00 is required to process this application, which includes<\/p>\n
preconstruction site assessment, plan preparation and regulatory<\/p>\n
approval.<\/p>\n
The United Laguna Woods Mutual (ULWM) will direct its agent to<\/p>\n
notify all adjoining residents of the building of the requested lift. If<\/p>\n
three or more residents of the building object to the installation of the<\/p>\n
lift, the matter will be brought before the board.<\/p>\n
If the requesting member(s) choose to install an elevator\/platform lift<\/p>\n
for any reason other than a disability, approval of all of the members<\/p>\n
in the building is requires.
\n6. The United Laguna Woods Mutual (ULWM) will direct its agent, on<\/p>\n
behalf of the requesting members(s) to contract with licensed,<\/p>\n
insured architectural and engineering consultants to modify standard<\/p>\n
plans to accommodate a variety of site-specific conditions, and<\/p>\n
indicate exactly where the elevator\/platform lift will be installed on the<\/p>\n
Corporation\u2019s property.<\/p>\n
Structural modifications and or requirements will be performed by<\/p>\n
California licensed architect or civil\/structural engineer and provided<\/p>\n
by the mutual in the standard plans.<\/p>\n
These plans must illustrate all modifications and or additions<\/p>\n
to existing mutual property and must include the following:<\/p>\n
a)<\/p>\n
Site plan<\/p>\n
b) Floor plan<\/p>\n
\u00a2) Roof plan<\/p>\n
d) Electrical plan<\/p>\n
e) Elevations<\/p>\n
f)<\/p>\n
Section(s)<\/p>\n
g) Details<\/p>\n
Construction<\/p>\n
1<\/p>\n
The amount of final payment will be determined at the time of<\/p>\n
construction contract bid acceptance. Final payment is due in the<\/p>\n
form of a lump sum, prior to construction contract execution. The<\/p>\n
unused portion of the deposit, if any, will be applied toward final<\/p>\n
payment.<\/p>\n
If the requesting member(s) decides not to proceed with installation<\/p>\n
of elevator\/platform lift prior to execution of construction contract, the<\/p>\n
unused portion of the deposit will be refunded.<\/p>\n
If the requesting member(s) decides not to proceed with installation<\/p>\n
of the elevator\/platform lift after execution of construction contract,<\/p>\n
the unused portion of the deposit along with the unused portion of<\/p>\n
final payment will be refunded, after satisfying the terms and<\/p>\n
conditions of applicable contracts and restoring the building to its<\/p>\n
preconstruction conditions.
\nOn behalf of the member, staff will contract with a licensed and<\/p>\n
insured installer to perform the installation. Staff will also inspect the<\/p>\n
alteration\/construction. Additionally, staff will obtain all permits or<\/p>\n
licenses necessary for the installation and ongoing operation of the<\/p>\n
lift, prior to final inspection of the construction and the awarding of the<\/p>\n
operating permit.<\/p>\n
The requesting member(s) shall acknowledge and agree that upon<\/p>\n
completion of construction and issuance of a permit to operate an<\/p>\n
elevator\/platform lift by the regulatory authority, the mutual will<\/p>\n
assume ownership of the improvement. The mutual will be<\/p>\n
responsible for the cost for the ongoing maintenance, repair, annual<\/p>\n
operation certification, insurance, replacement reserves, and cost for<\/p>\n
power.<\/p>\n
Member(s) further agree that once the lift is installed on mutual<\/p>\n
property, members shall have no right to remove or restrict the use of<\/p>\n
the lift in any way.<\/p>\n
The member(s) shall agree that said lift is open and available to any<\/p>\n
resident in the mutual and or their guests requiring use for handicap<\/p>\n
access.
