{"id":48819,"date":"2018-10-05T00:00:00","date_gmt":"2018-10-05T07:00:00","guid":{"rendered":"https:\/\/dev-laguna-woods.pantheonsite.io\/document\/interior-inspection-of-unoccupied-unit-policy\/"},"modified":"2026-03-26T13:00:52","modified_gmt":"2026-03-26T20:00:52","slug":"united-unoccupied-unit-inspection-policy","status":"publish","type":"document","link":"https:\/\/lagunawoodsvillage.com\/fr\/document\/united-unoccupied-unit-inspection-policy\/","title":{"rendered":"United Unoccupied Unit Inspection Policy"},"content":{"rendered":"<p>UNITED LAGUNA WOODS<\/p>\n<p>MUTUEL<\/p>\n<p>RESOLUTION 01-26-19<\/p>\n<p>Unoccupied Unit Inspection Policy<\/p>\n<p>REVISED JUNE 2018, RESOLUTION 01-18-54<\/p>\n<p>REVISED FEBRUARY 2026, RESOLUTION 01-26-19<\/p>\n<p>WHEREAS, unoccupied Units present a number of concerns to United Mutual and its<\/p>\n<p>shareholders, including without limitation, potential damage to the Mutual&#8217;s Common Areas, and<\/p>\n<p>those concerns increase the longer the Unit is unoccupied; and<\/p>\n<p>WHEREAS, the fiduciary responsibility of the Board is to protect the Mutual&#8217;s assets and it is to<\/p>\n<p>the benefit of the Mutual and its shareholders to inspect the condition of Units which have been<\/p>\n<p>unoccupied for a period of six (6) months or more, or which are reasonably believed to pose<\/p>\n<p>potential maintenance concerns; and<\/p>\n<p>WHEREAS, based on the advice of the Mutual&#8217;s legal counsel and consistent with the Mutual&#8217;s<\/p>\n<p>governing documents, the Mutual has the right to access a Shareholders Unit at any time in the<\/p>\n<p>event of an emergency and the right to access a Shareholders Unit at a reasonable hour in non-<\/p>\n<p>emergency situations for the purpose of inspection;<\/p>\n<p>NOW THEREFORE, BE IT RESOLVED, February 10, 2026, that the Board of Directors hereby<\/p>\n<p>adopts the Unoccupied Unit Inspection Policy; and<\/p>\n<p>RESOLVED FURTHER, if a Unit remains unoccupied for longer than six (6) months and every<\/p>\n<p>subsequent six (6) month period, a notification (via email or mail) will be sent to the Unit<\/p>\n<p>Shareholder informing them of an upcoming Unit inspection per the Unoccupied Unit Inspection<\/p>\n<p>Policy. This notification will provide an overview of the inspection process and will include a copy<\/p>\n<p>of the current policy; and<\/p>\n<p>RESOLVED FURTHER, that except in case of an emergency inspection, in which case the<\/p>\n<p>Mutual or a representative thereof may enter without prior notice to the Unit Shareholder, the<\/p>\n<p>Mutual must provide a second and final written notice (via email or mail) to the Shareholder of<\/p>\n<p>record of each Unit that is unoccupied or presumed to be unoccupied a minimum of fifteen (15)<\/p>\n<p>days\u2019 prior to any inspection scheduled to be carried out in a Unit in accordance with this<\/p>\n<p>Policy; and<\/p>\n<p>RESOLVED FURTHER, that the Shareholder is encouraged to be present, but it is not<\/p>\n<p>mandatory; and<\/p>\n<p>RESOLVED FURTHER, the Mutual will conduct non-emergency inspections in accordance with<\/p>\n<p>said notice of inspection and charge to the<\/p>\n<p>Shareholder any and all administrative costs\/fees as set by the Mutual for each such inspection,<br \/>\nincluding the cost of gaining entrance into the Unit, as may be applicable; and<\/p>\n<p>RESOLVED FURTHER, if the Shareholder of record of an unoccupied Unit object in writing to<\/p>\n<p>the inspection of such Unit or specifically denies entry, the matter may be referred to the Board for<\/p>\n<p>member disciplinary action; and<\/p>\n<p>RESOLVED FURTHER, within forty-eight (48) hours prior to the inspection, if the Shareholder<\/p>\n<p>does not provide a key (or digital access) and there is no key on file with the Resident Services<\/p>\n<p>Key File Program, the staff (or authorized agent) at their sole discretion can enlist the services<\/p>\n<p>of a locksmith. The member is responsible for the cost of these services; and<\/p>\n<p>RESOLVE FURTHER,<\/p>\n<p>to offset administrative costs associated with processing<\/p>\n<p>et<\/p>\n<p>performing unoccupied unit inspections, the Board of Directors of this Corporation hereby<\/p>\n<p>adopt the unoccupied unit inspection fees in the amount of $276 per inspection. The member is<\/p>\n<p>responsible for all costs associated with inspection; and<\/p>\n<p>RESOLVE FURTHER, that additional costs may be charged to the member for any required<\/p>\n<p>services deemed necessary to complete the inspection such as the services of a locksmith when<\/p>\n<p>there is no key on file, and to make any emergency repairs; and<\/p>\n<p>RESOLVED FURTHER, the inspector must identify and note conditions within each inspected Unit<\/p>\n<p>in a written report, which shall be provided to the Shareholder by emailing or mailing the report<\/p>\n<p>to the Shareholder\u2019s contact information as provided in the Mutual&#8217;s records, and facilitate the<\/p>\n<p>maintenance or remediation of adverse conditions identified to protect against damage to Mutual<\/p>\n<p>property, Common Area damage, or nuisance to neighboring Units and shareholders. The<\/p>\n<p>Shareholder will have thirty (30) days to cure the adverse conditions. If not remediated within<\/p>\n<p>\u2014<\/p>\n<p>at their sole discretion<\/p>\n<p>_<\/p>\n<p>that thirty (30) day period, the Mutual<\/p>\n<p>may perform said<\/p>\n<p>remediations as a chargeable service; and<\/p>\n<p>RESOLVED FURTHER, necessary emergency maintenance or repairs (meaning those that are<\/p>\n<p>required to prevent imminent damage or injury to persons or property) identified in the inspection<\/p>\n<p>will be carried out by the Mutual (or authorized agent) as a chargeable service in accordance with<\/p>\n<p>the Mutual&#8217;s governing documents; and<\/p>\n<p>RESOLVED FURTHER, that necessary emergency maintenance and repairs that are the<\/p>\n<p>responsibility of the Mutual will be carried out at the Mutual&#8217;s expense; and<\/p>\n<p>RESOLVED FURTHER,<\/p>\n<p>that Resolution 01-18-54 adopted June 12, 2018,<\/p>\n<p>is hereby<\/p>\n<p>superseded and cancelled;
