HOLD HARMLESS, RELEASE AND WAIVER OF LIABILITY AGREEMENT<\/p>\n
THIS AGREEMENT LIMITS THE LIABILITY OF THE GOLDEN RAIN FOUNDATION OF LAGUNA<\/p>\n
WOODS (\u201cGRF\u201d), A CALIFORNIA NONPROFIT MUTUAL BENEFIT CORPORATION, AND<\/p>\n
VILLAGE MANAGEMENT SERVICES, INC. (\u201cVMSI\u201d) A CALIFORNIA CORPORATION, AND<\/p>\n
EACH OF THEIR RESPECTIVE DIRECTORS,<\/p>\n
OFFICERS,<\/p>\n
EMPLOYEES,<\/p>\n
AGENTS,<\/p>\n
SUCCESSORS AND ASSIGNS (ALL HEREAFTER COLLECTIVELY REFERRED TO AS \u201cGRF<\/p>\n
RELEASEES\u201d) AND WAIVES ANY CLAIM YOU MAY HAVE AGAINST GRF RELEASEES FOR<\/p>\n
INJURY OR DAMAGE, EXCEPT THAT WHICH ARISES FROM THE GROSS NEGLIGENCE OR<\/p>\n
WILLFUL MISCONDUCT OF GRF RELEASEES.<\/p>\n
PLEASE READ CAREFULLY IT BEFORE<\/p>\n
SIGNING AND USING THE FACILITIES OR ANY EQUIPMENT.<\/p>\n
I<\/p>\n
, register to instruct or participate in<\/p>\n
activities at the Garden Center, a GRF facility and to use the facilities and equipment present<\/p>\n
therein.<\/p>\n
| am aware that the use of the facilities and equipment presents a risk of injury to me<\/p>\n
and | am aware of the existing condition of the tree plots. | also am aware this includes, but is<\/p>\n
not limited, to uneven terrain and slopes.<\/p>\n
I, on behalf of myself, my personal representatives, heirs and next of kin, warrant and<\/p>\n
agree as follows:<\/p>\n
1<\/p>\n
| understand that the use of the facilities, equipment, services, programs and<\/p>\n
premises includes an inherent risk of injury to persons and property;<\/p>\n
2<\/p>\n
| agree that all use of facilities, equipment and services, programs and premises are<\/p>\n
undertaken by me and at my sole risk.<\/p>\n
I am in good physical condition and have no disabilities, diseases, illnesses, or other<\/p>\n
conditions that could prevent me from using the facilities and equipment without<\/p>\n
injuring myself or impairing my health and;<\/p>\n
| agree to disclose any special medical conditions or limitations to facility staff before<\/p>\n
using the GRF facilities or equipment.<\/p>\n
| understand that risk of injury includes, but is not limited to,<\/p>\n
a<\/p>\n
injuries arising from or relating to the use by myself or others of equipment and<\/p>\n
machines, locker rooms, wet areas and other amenities;<\/p>\n
b<\/p>\n
injuries arising from or relating to participation by myself or others in supervised<\/p>\n
and unsupervised activities or programs throughout the facilities;<\/p>\n

injuries and medical disorders arising from or relating to the use of the facilities<\/p>\n
or equipment such as lacerations, abrasions, contusions, punctures, crushed<\/p>\n
appendages, amputations, burns, eye injuries or blindness, hearing loss, heart<\/p>\n
attack, stroke, death, heat stress, sprains, strains, broken bones, and torn<\/p>\n
muscles, tendons and ligaments among others; and<\/p>\n
accidental injuries occurring anywhere in the facilities including lobbies, hallways,<\/p>\n
storage areas, locker rooms, or activities associated with GRF which are carried<\/p>\n
on anywhere or while | am traveling to or from the facility.

Accidental injuries include but are not limited to, those caused by myself, those<\/p>\n
caused by personal property, materials, equipment, apparel, other persons, GRF<\/p>\n
Releasees and those of a slip and fall nature.<\/p>\n
| waive all claims which | or my personal representatives, heirs and next of kin may<\/p>\n
have against GRF Releasees, and on behalf of myself and my personal<\/p>\n
representatives, heirs and next of kin, release and agree to hold GRF Releasees<\/p>\n
absolutely harmless from all claims, demands, injuries, damages, actions, suits, or<\/p>\n
causes of action to persons or property, arising out of or in any way connected with<\/p>\n
my or others use of the facilities, equipment, premises, services or programs,<\/p>\n
including those arising out of any active or passive negligent act or omission of GRF<\/p>\n
Releasees, except that which arises out of the gross negligence or willful<\/p>\n
misconduct of GRF Releasees.<\/p>\n
| agree to indemnify, defend and hold GRF Releasees absolutely harmless from all<\/p>\n
claims, demands, injuries, damages, actions, suits, or causes of action to persons or<\/p>\n
property, arising out of or in any way connected with my or others use of the Garden<\/p>\n
Center Tree Plots facilities, including those arising out of any active or passive<\/p>\n
negligent act or omission of GRF Releasees, except that which arises out of the<\/p>\n
gross negligence or willful misconduct of GRF Releasees.<\/p>\n
| agree that | am solely responsible for loss or damage to my property in addition to<\/p>\n
property of others in my care or otherwise entrusted to me.<\/p>\n
10<\/p>\n
| have carefully read this Hold Harmless, Release and Waiver of Liability Agreement<\/p>\n
and fully understand it is a release of liability. | am waiving any right that | may have<\/p>\n
to bring legal action or assert a claim against GRF Releasees for negligence, except<\/p>\n
that which arises from the gross negligence or willful misconduct of GRF Releasees.<\/p>\n
| agree that this HOLD HARMLESS, RELEASE AND WAIVER OF LIABILITY AGREEMENT is<\/p>\n
intended to be as broad and inclusive as permitted by the laws of the State of California, and<\/p>\n
that if any portion is ruled invalid, the balance shall continue in full legal force and effect.<\/p>\n
| HAVE READ AND VOLUNTARILY SIGN THIS HOLD HARMLESS, RELEASE AND WAIVER<\/p>\n
OF LIABILITY AGREEMENT, which shall remain in effect for so long as | shall use the<\/p>\n
facilities or equipment and agree that no oral agreements, representations, statements or<\/p>\n
inducements apart from this written agreement have been made.<\/p>\n
| HAVE READ THIS AGREEMENT AND UNDERSTAND THAT IT LIMITS THE LIABILITY OF<\/p>\n
GRF RELEASEES AND WAIVES ANY CLAIM FOR ANY INJURY | MAY SUSTAIN, OR<\/p>\n
LOSS OF, OR DAMAGE TO, MY PROPERTY IN CONNECTION WITH MY USE OF THE<\/p>\n
FACILITIES OR EQUIPMENT.<\/p>\n
